Terms and Conditions for the Sale of Goods and the Supply of Services (Abridged Version)

Supply of the Goods and the Specified Service
|

1.1
|
(a)
|
It is up to you to supply us with all the information required in plenty time to carry out the work required.
|
|
 
|
(b)
|
It is up to you to ensure the accuracy of any information you give us.
|
|
1.2
|
You should keep copies of any information you give us for reference.
|
|
1.3
|
It is your responsibility to ensure you have any permissions required for any work you ask us to carry out and further that the work will not infringe any copyrights, patents etc.
|
|
1.4
|
We may have to make changes to the work that has been agreed to be done in order to comply with safety or other statutory requirements.
|
|
1.5
|
If you cancel an order we may require you to pay for any costs we have incurred.
|

|
Charges
|
|
2.1
|
We may have to make additional charges to cover any costs we incur as a result of unforeseen work required to complete the installation.
|
|
2.2
|
We may have to increase the quoted price if events out with our control result in our costs increasing, but we will discuss this with you should this be required.
|
|
2.3
|
All work requires a 20% deposit on order, the materials must be paid for in full prior to installation, and the remaining balance to be paid to the installers on immediate completion of the installation. If paying for the materials by cheque the cheque must be received by TFS Fireplace Centres Ltd. at least 5 full days prior to installation.

Delivery of the Goods
|

3.1
|
Whilst we will try to do deliveries at the agreed time, we cannot guarantee that we will always be able to do this.
|
|
3.2
|
If you are unable to take delivery at the agreed time we may have to make an additional charge to cover re-delivery.
|

4
|
Risk and Property
|
|
4.1
|
You are responsible for any loss or damage to any goods that have been delivered to you, although the goods remain our property until paid for in full.
|
 |
5
|
Warranties and Liability
|
|
5.1
|
Subject to the conditions set out below we warrant that the goods will correspond with their specification at the time of delivery and will be free from defects in material and workmanship for a period of 12 months from the date of their initial use or 12 months from delivery, whichever is the first to expire.

5.2
|
The above warranty is given subject to the following conditions:

5.2.1
|
Any defect is not as a result of any error or omission in any information supplied to us by you;
|
|
 
|
5.2.2
|
Any defect is not as a result of fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow our instructions (whether oral or in writing), misuse or alteration or repair of the goods without the our approval;
|
|
 
|
5.2.3
|
The goods have been paid for in full;
|
|
 
|
5.2.4
|
The above warranty does not extend to parts, materials or equipment not manufactured by the us, in respect of which you shall only be entitled to the benefit of any such warranty or guarantee as is given by the manufacturer to the us.

5.2.5
|
Most coloured stones & marbles are inherently unsound and this may vary from hairline cracks in some varieties to brecciation in others. Generally speaking, the more figure a stone contains the greater the need for reinforcement, repair and filling in one form or another. Fortunately, with modern techniques and skills these repairs and fillings can be well concealed and the parts so treated are normally the stronger sections of the stone; you should not therefore be regard these in any way as defects; all natural stones & marble are porous and can be affected by alkalines, acids & possible heat discolouration.

5.2.6
|
In the course of developing a quarry, considerable variation often occurs in the colour and veining of the stone extracted, and for this reason close uniformity of appearance is not natural and should not be expected;
|

5.2.7
|
When for reasons of size or expansion, stone has to be in two or more pieces, it is sometimes impossible to match the graining exactly to conceal the joints;
|
|
 
|
5.2.8
|
Due to the casting process, all measurements of cast iron goods are approximate and may vary slightly;
|
|
 
|
5.2.9
|
Polished Cast Iron, Brass and other metals are not recommended for solid fuel fires as some discoloration may occur. Occasionally this process, which does not affect the serviceability of the product, may also occur with high output gas fires. If a slight change in colour will cause distress it is strongly recommended that black products be installed.

|
5.2.10
|
When burning Solid Fuel, a new fireplace must be tempered by burning small fires initially.
|
|
 
|
5.2.11
|
No warranty is given on materials supplied for solid fuel installations, due to the variable temperatures that can be generated by different types of fuel used.
|
|
 
|
5.2.12
|
Shading and crazing are inherent characteristics of glazed tiles.
|
|
 
|
5.2.13
|
Chimney/Flue must be checked by a chimney specialist prior to installation and a copy of certificate supplied to TFS Fireplace Centres Ltd.
|
|
5.3
|
Any claim which is based on any defect in the quality or conditions of the goods shall be notified to us within 3 days from the date of delivery or (where the defect or failure was not apparent on reasonable inspection) within a reasonable time after discovery of the defect or failure.
